1. Products and Services
Access to services or purchase of products offered on the Site may be subject to the creation of an account that requires the registration of certain information by the User.
We do not sell products to minors. Children's products available on Motoscoot must be purchased by adults. Motoscoot services may only be used by minors under the supervision of an adult.
All products sold by Motoscoot.net are exclusive for competition (not to be used on public roads) unless it is specifically indicated in the product sheet that it has the required homologations.
Certain products or services may be available exclusively through the website. These products or services may have limited quantities and be subject to return or exchange in accordance with our return policy. There is no guarantee that the monitor of your computer or screen of your device will show the colours of the products exactly.
2. Modifications to the Service and Prices
The prices of the products and services are subject to change without prior notice. The prices of the products exclude the expenses of the services, which will be added to the total amount before proceeding to the payment, or failing that, the customer will be informed that the customer service will contact to offer the best possible offer. 3. Purchase Conditions
The ownership of goods will not be transmitted to the Client until the total cost of the agreed-upon price has been covered. Until then, the property of the goods will be reserved on behalf of the buyer.
With no damage to the remaining Purchase Conditions, the property of the goods will not be transmitted to the Client until the payment has been fulfilled in its entirety. Until then, ownership of goods will be reserved to MS Properformance 2008 SL and any products held by the Client are considered a deposit. The Client must store the goods in such a way that it is easily identified as the property of MS Properformance 2008 SL. In the event that there is any doubt regarding the existence or not of a deposit for a certain good due to its incorrect identification by the Client, the goods will be considered a deposit. On the event of lack of payment or delayed payment by the Client, MS Properformance 2008 SL reserves the right to remove any goods that are being stored in the Client's facilities that by doing so irrevocably grants access to its facilities by MS Properformance 2008 SL to collect such goods.
All articles of deliveries (reserved goods) remain the property of MS Properformance 2008 S.L. until the fulfilment of all obligations regarding the business relationship.
The cancellation and/or modification of the order will not be possible after the order has been processed, and the customer has received the order invoice. Once the customer has received the order at the chosen destination, they can return any product following our Returns Policy.
4. Payment
The Customer may use PayPal, VISA and Mastercard or transfer as a means of payment; provided it does not have any kind of restriction (due to misuse, country of destination or amount of the order). All payments made entails the issuance of an invoice in the name of the registered user. This invoice will be automatically sent to the email address provided by the user.
By purchasing with Scalapay the Customer will receive his order immediately and pay in the number of instalments he has set. The Customer agrees that the instalments may be assigned to Retail Instalments SPV 1 Limited, related parties and their assignees, and authorises such assignment. Scalapay is available for purchases in the following countries: Austria, Belgium, Netherlands, Finland, France, Germany, Italy, Portugal and Spain.
5. Warranty
As indicated by the law, a guarantee is managed during the first 24 months from the date of purchase. The warranty covers possible manufacturing defects and excludes misuse by the customer. It is essential to provide the invoice of purchase. Competition and electronic materials have a lower warranty time limit, or may not have it, depending on the manufacturer. 6. Return Conditions
Returns are processed online or on any of our physical stores. The customer has 30 days to return a product.
The refund will be processed in the same means of payment used for the purchase, or by the allocation of credit in the personal account of the client in the portal motoscoot.net.
You can accredit the exercise of the right of withdrawal in any manner admitted by law, considering yourself validly exercised by sending a return form that we provide. Once printed, the client must fill in and attach it to his return. It is mandatory to fill out and send the returns form.
The direct expenses caused by the return will be paid by the client. Returns are not accepted if the packaging of the product and all its components are not original or if they are not in perfect condition. Likewise, returns of products assembled, used or with clear signs of handling are not accepted. Returns of items that are not in conditions for subsequent sale are not accepted.

7. Deliveries
The delivery will be made at the same address previously designated by the user. The provider assumes no responsibility when the delivery is not made as a result of the data provided being false, inaccurate or incomplete or when the delivery cannot be made for reasons beyond the company's delivery as is the absence of the recipient. If any deterioration or defect in the package received is detected, it must be recorded before signing the receipt of delivery and must be communicated to Motoscoot within 24 hours of receiving the package. The package must be checked at the time of delivery in order to verify that the condition of the merchandise is correct, otherwise, you must notify Motoscoot.net within 24 hours of receiving the package. Motoscoot.net does not assume responsibility in any way if the warnings mentioned above are not met. If for some reason it is not possible to comply with the delivery date, the customer will be informed of this circumstance and we will give him the option to continue with the purchase by establishing a new date or cancelling the order.

8. Customs
When you place an order for products on Motoscoot.net for delivery to a country outside the European Union, you may be required to pay import duties and taxes, which will be charged to you at the time the package reaches your destination. Any additional amount due to customs clearance will be the responsibility of the Client. Customs policies vary significantly from one country to another so we advise you to consult with the corresponding customs office.
9. Communication and other contents
Users may publish their questions and comments, provided that the content is not unlawful, obscene, abusive, constitutes a threat or defamation, or invades the privacy of third parties, infringes intellectual property rights or otherwise results offensive to third parties or reprehensible, or consist of or contains computer viruses, political propaganda or advertising content, chain emails, mass mailings or constitutes any other type of "spam". It is not allowed to use false email addresses, or impersonate the identity of another person or entity, or falsify in any other way the origin of any other content.
10. Campaigns, Promotions, Offers and Flash Sales
All promotions, offers, flash sales, discount codes, coupons, and other campaigns, hereafter known as campaigns, are valid only during the stated period. No campaign is applicable retroactively or after the end of the campaign.
Products are only subject to a promotion, discount or offer during the campaign period and, as such, must be purchased during the campaign's validity period. Products added to the cart during the campaign period, which are purchased after the end of the campaign, do not enjoy discounts or promotions.
All campaigns are limited to existing stock. Once the availability of the products on sale ends, the campaign will automatically be over.

The discounts advertised on flash sales and during Black Friday campaigns are always over the retail price of the product on offer.
Campaigns, promotions, discounts and offers are made on an individual basis and are not cumulative with other promotions unless expressly stated otherwise in the campaign conditions.
Discount codes and coupons will be void if they are changed, copied, transferred, auctioned or sold.
Discounts do not apply to ship and handling costs, taxes or fees. They cannot be exchanged for cash or credit, nor transmitted to third parties.
In case of return of a product purchased during a campaign, the refund will be equivalent to the price of the product once the discount is applied.

Christmas Flash Sale Campaign
By participating in this campaign, you accept and agree to comply with the following terms and conditions:
Duration of the Campaign: The Christmas Flash Sale Campaign will run from 12 December 2023 until 8 January 2024.
Validity of Stock: The discounts applied in this campaign are subject to the existing stock of the products included in the promotion. Motoscoot does not guarantee the availability of products on offer.
Returns: In case of return of a product purchased during the Christmas Flash Sale Campaign, the value of the product will be refunded according to the purchase price.
Duration of Discounts: Discounts applied to products on promotion will only be valid during the week in which the product is on offer. The duration of the offers may vary depending on the product.

11. Applicable legislation
This contract is governed by the applicable Spanish legislation. The parties agree to submit to the resolution of any controversy, conflict, or claim derived from this contract to the courts of Spain, as the place where the contract is concluded and of the provision of the services object of this contract.
